1. Acceptance of Terms
By accessing or using Creator Wallet ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Creator Wallet is a platform that aggregates revenue data from multiple third-party platforms (including but not limited to Shopify, Facebook, Instagram, YouTube, TikTok, Stripe, Etsy, Patreon, and Amazon Affiliate) into a unified dashboard. The Service provides:
- Aggregation and display of revenue data from connected platforms
- Revenue tracking across different time periods (today, this week, this month)
- Platform connection management
- Payment processing capabilities via Stripe Checkout
- Subscription-based membership tiers
3. User Accounts
3.1 Account Creation
To use the Service, you must create an account by providing a valid email address and creating a secure password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2 Account Responsibility
You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activities under your account
- Ensure you are at least 18 years old to use the Service
3.3 Account Security
You are solely responsible for safeguarding your password and for any actions taken using your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.
4. Platform Connections and Data
4.1 Third-Party Platform Authorization
When you connect a platform to Creator Wallet, you authorize us to access and retrieve data from that platform using the credentials (OAuth tokens, API keys) you provide. You are responsible for ensuring you have the legal right to authorize such access and that your use of the Service complies with the terms of service of each connected platform.
4.2 Data Accuracy
We aggregate revenue data from your connected platforms based on information provided by those platforms' APIs. We do not guarantee the accuracy, completeness, or timeliness of data retrieved from third-party platforms. The Service displays data as received from platform APIs, and we are not responsible for errors or discrepancies in data provided by third-party platforms.
4.3 Data Storage
We securely store your platform credentials and revenue data to provide the Service. You can disconnect platforms at any time, which will revoke our access and stop data collection from that platform. However, historical data may be retained in accordance with our Privacy Policy.
4.4 Platform Availability
The availability and functionality of platform connections depend on the third-party platforms' APIs and services. We are not responsible for service interruptions, API changes, or discontinuation of services by third-party platforms that may affect your ability to connect or retrieve data.
5. Subscription and Payment Terms
5.1 Free and Paid Plans
Creator Wallet offers both free and paid subscription plans. Free users are limited to connecting one platform. Paid subscribers can connect unlimited platforms. Subscription fees, features, and limitations are subject to change with notice.
5.2 Payment Processing
Payments for subscriptions are processed through Stripe. By subscribing, you agree to Stripe's terms of service and privacy policy. We do not store your full payment card information. All payment data is handled by Stripe in accordance with their security standards.
5.3 Billing and Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged the subscription fee at the beginning of each billing cycle. You can cancel your subscription at any time through your account settings or by contacting us.
5.4 Refunds
Subscription fees are non-refundable except as required by applicable law or as determined at our sole discretion in exceptional circumstances. If you cancel your subscription, you will continue to have access to paid features until the end of your current billing period. No refunds will be provided for partial billing periods or unused portions of your subscription. Refund requests must be submitted within 14 days of the original charge date and will be evaluated on a case-by-case basis.
6. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Violate or infringe upon the rights of others, including intellectual property rights
- Attempt to gain unauthorized access to the Service or any connected systems
- Interfere with or disrupt the Service or servers connected to the Service
- Use automated systems (bots, scrapers) to access the Service without permission
- Share your account credentials with others or create multiple accounts to circumvent subscription limitations
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to transmit viruses, malware, or other harmful code
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
7. Intellectual Property
7.1 Our Intellectual Property
The Service, including its original content, features, functionality, design, and software, is owned by Creator Wallet and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
7.2 Your Content
You retain ownership of any data, content, or information you provide to the Service. By using the Service, you grant us a limited, non-exclusive, royalty-free license to use, store, and process your data solely for the purpose of providing the Service to you.
8. Disclaimers and Limitations of Liability
8.1 Service Availability
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
8.2 Data Accuracy Disclaimer
We aggregate data from third-party platforms and display it as received. We do not verify, validate, or guarantee the accuracy of data provided by third-party platforms. You should verify important financial information directly with the source platforms and not rely solely on the Service for financial decisions.
8.3 Limitation of Liability
To the maximum extent permitted by law, Creator Wallet and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
8.4 Maximum Liability
Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
9. Indemnification
You agree to indemnify, defend, and hold harmless Creator Wallet and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.
10. Termination
10.1 Termination by You
You may terminate your account at any time by deleting your account through the Service or by contacting us. Upon termination, your right to use the Service will immediately cease.
10.2 Termination by Us
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
10.3 Effect of Termination
Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Third-Party Services
The Service integrates with and relies on third-party platforms and services (e.g., Shopify, Facebook, YouTube, Stripe). Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services. Any issues with third-party services should be directed to the respective service provider.
12. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Delaware, United States, and shall be conducted in the English language. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.
Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights or to prevent irreparable harm. This arbitration provision does not apply to disputes that are prohibited from arbitration by applicable law.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Creator Wallet regarding the Service and supersede all prior agreements and understandings, whether written or oral.
